Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Whiptail Coffee website, online store, customer accounts, subscriptions, content, and related services (collectively, the “Site”). The Site is operated by Whiptail Coffee LLC (“Whiptail,” “we,” “us,” or “our”).

By accessing the Site, creating an account, placing an order, or starting a subscription, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Site.

  1. ELIGIBILITY AND LAWFUL USE

    You must be at least 18 years old, or the age of legal majority where you live, to make a purchase or create an account. You may use the Site only for lawful purposes and in accordance with these Terms.

  2. ACCOUNTS

    You are responsible for providing accurate, current information and for maintaining the confidentiality of your login credentials. You are responsible for activity under your account.

    Notify us promptly at info@whiptail.coffee if you believe your account has been accessed without authorization. We may suspend or close accounts used fraudulently, unlawfully, or in violation of these Terms.

  3. PRODUCTS AND AVAILABILITY

    Coffee is an agricultural product. Crop, roast, and seasonal differences may cause reasonable variations in appearance, aroma, flavor, availability, packaging, and product descriptions. Tasting notes describe our sensory impressions and are not guarantees of how a coffee will taste to every customer.

    Products and subscription selections are subject to availability. We may limit quantities, substitute a comparable coffee when a subscription permits substitutions, discontinue products, or cancel an order. If we cancel an item before shipment, we will refund the amount paid for that item.

  4. PRICES, PAYMENT, AND TAXES

    Prices are shown in U.S. dollars and may change without notice. The price displayed at checkout when you submit an order controls, except in the case of an obvious pricing or listing error.

    Applicable taxes and shipping charges are added at checkout. You authorize us and our payment service providers to charge the payment method you provide for your order and, if applicable, recurring subscription charges.

    We may refuse or cancel orders affected by suspected fraud, unauthorized payment activity, inventory errors, technical errors, or incorrect pricing. If we cancel an order after payment, we will issue an appropriate refund.

  5. ORDER ACCEPTANCE AND CANCELLATION

    An order confirmation acknowledges that we received your order. It does not guarantee acceptance. We may accept, reject, limit, or cancel an order as permitted by law.

    One-time orders and individual subscription orders may be canceled for a full refund until Friday at 12:00 p.m. Pacific Time before the applicable Saturday roast day. To request cancellation, email info@whiptail.coffee. Requests received after the cutoff may be denied because roasting, fulfillment, or shipment processing may have begun.

    Subscriptions renew and are charged automatically at the frequency shown during checkout, based on the date the customer originally subscribed. Canceling or pausing a subscription before the next scheduled charge prevents future renewals.

    Canceling a subscription after a renewal charge has been processed does not automatically cancel or refund that individual order. To request cancellation of a processed subscription order, contact us before the Friday cancellation cutoff stated above.

  6. SHIPPING, RETURNS, AND SUBSCRIPTIONS

    Our Shipping and Delivery Policy, Returns and Refunds Policy, and Subscription Policy are incorporated into these Terms.

  7. INTELLECTUAL PROPERTY

    The Site and its content, including Whiptail’s name, logos, product names, photographs, artwork, graphics, text, design, and other materials, are owned by or licensed to Whiptail and are protected by intellectual property laws.

    You may use the Site for personal, noncommercial shopping and informational purposes. You may not copy, reproduce, modify, distribute, sell, exploit, scrape, or create derivative works from Site content without our prior written permission, except as permitted by law.

  8. REVIEWS AND OTHER SUBMISSIONS

    If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights.

    You grant Whiptail a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission in connection with Whiptail’s business and marketing. We may remove submissions at our discretion.

  9. PROHIBITED CONDUCT

    You may not:

    • Interfere with the Site’s operation or security.

    • Introduce malware or harmful code.

    • Attempt to gain unauthorized access to the Site, customer accounts, or related systems.

    • Impersonate another person or misrepresent your identity.

    • Use automated systems to extract or scrape Site content.

    • Submit fraudulent or unauthorized orders.

    • Violate another person’s intellectual property, privacy, or other rights.

    • Use the Site in a manner that violates applicable law.

  10. THIRD-PARTY SERVICES AND LINKS

    The Site may rely on or link to third-party services, including website hosting providers, payment processors, shipping carriers, analytics providers, and social platforms.

    Their services may be governed by separate terms and privacy policies. We are not responsible for third-party sites or services except to the extent required by law.

  11. DISCLAIMER

    TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

    WHIPTAIL DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

    THIS DISCLAIMER DOES NOT LIMIT ANY WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.

  12. LIMITATION OF LIABILITY

    TO THE FULLEST EXTENT PERMITTED BY LAW, WHIPTAIL AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM THE SITE OR THESE TERMS.

    WHIPTAIL’S TOTAL LIABILITY FOR A CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID WHIPTAIL FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

    THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

  13. INDEMNIFICATION

    To the extent permitted by law, you agree to indemnify and hold Whiptail harmless from third-party claims, losses, and reasonable expenses arising from your unlawful misuse of the Site, your violation of these Terms, or your violation of another person’s rights.

  14. GOVERNING LAW AND DISPUTES

    These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

    Before filing a claim, you and Whiptail agree to make a good-faith effort to resolve the issue by contacting the other party.

    Subject to applicable consumer law and small claims jurisdiction, legal proceedings relating to these Terms will be brought in the state or federal courts located in Alameda County, California.

    Nothing in these Terms limits rights you may have under the mandatory laws of your state of residence.

  15. CHANGES, SEVERABILITY, AND ENTIRE AGREEMENT

    We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless otherwise stated or required by law.

    If a provision is found to be unenforceable, the remaining provisions will remain in effect.

    These Terms and the policies incorporated into them are the entire agreement between you and Whiptail regarding the Site, except for any separate written agreement that expressly applies.
